The EAA applies to any business that provides digital products or services to customers in EU member states, regardless of where the business is headquartered. If your website, app, or software is accessible to European customers and you accept transactions or deliver services there, you fall under the EAA. This includes: e-commerce platforms, SaaS products, financial services, streaming and media, and professional services delivered online.

Enforcement is handled by designated national authorities in each EU member state. Penalties vary by country but include fines, injunctions requiring corrective action, and market access restrictions. For B2B businesses, EAA compliance is increasingly a procurement requirement. Enterprise buyers and government clients in Europe are beginning to require documentation of accessibility conformance as a condition of contract.

Three Immediate Steps
- Determine your exposure — Assess whether your digital products or services reach EU customers and which of those fall under the EAA product and service categories.
- Commission an audit — A WCAG 2.1 AA audit establishes your current conformance baseline and identifies your highest-risk gaps. This is the evidence you need to demonstrate good-faith effort if a complaint is filed.
- Document your conformance — An Accessibility Conformance Report (ACR) is the primary documentation format used to demonstrate EAA compliance to regulators and procurement teams.
